Webinar – Defending the Defenders: A Webinar on Combating SLAPPs in Africa

The recent CASA webinar, “Defending the Defenders Combating Strategic Lawsuits Against Public Participation (SLAPPs)”, was a dynamic event that ignited conversations and actions across the advocacy spectrum. CASA’s mission to support public watchdogs and advocates against SLAPPs took centre stage, reinforcing the principle “If one is targeted, all are targeted.”
Critical Discussions
The webinar provided an in-depth exploration of CASA’s vital role in supporting defenders against SLAPPs through robust discussions and presentations. Key highlights included the imminent launch of the SARW Anti-SLAPP Toolkit, a comprehensive resource designed to empower advocates with practical strategies to effectively counter SLAPPs. The discussions about the SLAPP suit against SARW by Canadian Mining company First Quantum Minerals (FQM) illuminated the real-world impacts of SLAPP suits, while explorations of policy roles in environmental protection were particularly enlightening. The role of media in raising awareness and advocating for change provided invaluable insights into our current status and the road ahead. Additionally, powerful discussions on human rights advocacy and the impacts of SLAPPs brought to light real-world experiences and challenges faced by grassroots movements, human rights defenders, journalists and community mobilisers.
Global and Local Legal Innovations
A central focus of the discussions was on “Building Legal Tools Against SLAPPs” and exploring “The Potentialities of the EU’s New Anti-SLAPP Directive.” Adopted in November 2023, this directive introduces critical mechanisms such as early dismissal procedures for unfounded lawsuits and penalties for those misusing the legal system. It broadens the scope to include cross-border cases within the European Union (EU), setting a precedent for similar protections worldwide.
Parallel to the EU’s efforts, participants delved into South Africa’s proposed model law to protect against SLAPPs, developed by the Centre for Applied Legal Studies (CALS) and Right2Protest (R2P). This model law aims to deter the misuse of legal processes, and proposes clear definitions and procedures for the swift dismissal of SLAPP suits, providing a blueprint for legislation that ensures the protection of public participation.
International Solidarity and CASA’s Mission
The significance of CASA’s mission was powerfully echoed at the 21st International Anti-Corruption Conference (IACC) held in Vilnius, Lithuania. At this conference on 24 June 2024, a pivotal motion titled “Defending the Defenders” was adopted, recognising the urgent need to protect those who courageously fight corruption, human right abuses and freedom of expression worldwide. This motion directly confronts global threats and calls for unwavering support for the integrity of anti-corruption defenders, aligning closely with CASA’s core mission. The motion was introduced amid accolades, with a special acknowledgement given to Mary Lawlor, the UN Special Rapporteur on the situation of human rights defenders, underscoring the importance of global alliances in these efforts.
This international recognition serves as a strong validation of the struggles faced by advocates and public watchdogs, many of whom encounter SLAPPs as a form of legal harassment. By highlighting the global community’s commitment to safeguarding these brave individuals, the IACC’s motion amplifies the message that protecting defenders is not only a matter of justice but also a crucial element of global anti-corruption efforts.
